TERMS AND CONDITIONS
Welcome to PLAY CREATE EAT! To ensure a safe, enjoyable, and seamless experience for all our guests, please review the following Terms and Conditions carefully. By accessing and using our facility, mobile application, and services, you agree to comply with these terms.
1. Registration and Family Account
1.1 Family Account Creation
A Family Account must be created through our mobile application (the “Application”) by a parent or legal guardian of the registered children during their first visit to our facility. The following conditions apply:
• The primary registrant must be at least 21 years old.
• The primary registrant must be a parent or a legal guardian of the registered child (children).
• The Family Account must include at least one adult (parent/legal guardian) and one child.
• Having an active Family account in the Application is the prerequisite for accessing and enjoying the services at the facilities. The guests are required to maintain sufficient Internet connection for their devices given that certain functionality of the Application might require the Internet.
• Family Account members are required to keep their log-in credentials confidential and safe, and to keep their personal data up to date for ensuring delivery of a proper service in view of the age categories.
1.2 Adding Members to the Family Account
• Additional adults (including but not limited to another parent, family member, legal guardian, caregiver, nanny, or driver) can be added via an invitation link.
• Additional children of the registrant can be added to the Family Account by the registrant or a second parent or legal guardian.
• Each newly added adult must review the previously signed waiver and confirm their acceptance of the terms and conditions.
1.3 Waiver Requirement
At the time of the first registration, the primary registrant must sign a waiver of liability, acknowledging and accepting liability terms. This waiver must be signed electronically via the link provided in the Application or on-site at the facility. The waiver is required for access to the facility.
2. Wallet and Payments
2.1 Wallet Functionality
• The Family Account includes a wallet feature accessible through the Application.
• Any adult within the Family Account can top up the wallet using a credit or debit card.
• Topping up the wallet means purchasing Points at the rate 1 AED = 1 Point, which can be then exchanged forproducts and services at PLAY CREATE EAT, including access to the play areas and products sold at the restaurant within the facility. Once purchased, Points are non-redeemable for cash and can only be used for the products and services within the facility.
• The wallet balance (Points) can be utilized by any member of the Family Account who is 16 years old and above, for purchases within the facility. Service provider (PLAY CREATE EAT) is not a party to disputes or claims between the Family Account members in case of improper use of the funds, nor the services provider shall refund any disputed purchase.
• The Points on the wallet balance are not transferrable to any other destination and for any other purpose than in return for the services at the facilities.
• Family Account members are required to accept the Terms and conditions of the payment services providers which hold the consumers’ wallets, available at [link]. The consumers shall not be permitted to pay for the services and enjoy them otherwise.
2.2 Loyalty Program
• Guests earn Star Points equal to up to 10% of every purchase made within the facility (excluding non-qualifying purchases as determined by the management).
• Star Points are credited to a designated loyalty account in the Application at a ratio of 1 Star Point = 1 AED.
• Star Points can be used to cover up to 20% of the total price of future visits or purchases at the facility.
• Loyalty points are promotional and non-redeemable for cash.
• Unused Star Points will expire after 12 months from the date of issuance.
2.3. Payments.
Any payments for the services are made in AED including VAT as applicable in the UAE by means (and within) the Application with appropriate amount written-off from the wallet. No other currency is accepted. When adding any other currency to the wallet, this shall be converted into the AED pursuant to the rates, terms and conditions of the payment services provider.
Only Family Account members aged 16+ are permitted to use the wallet for payments. Where the payment through the Application was made by a Family Account Member older than 16 but under 18 y.o., we assume that such apurchase was certified and approved by their parent or legal guardian.
Some purchases, i.e., above the designated amounts might require additional approval from the primary registrant. If that is the case, the push-notification shall be served via the Application to the primary registrant for their consent.
3. Facility Usage Rules
3.1 Play Area Policies
• Access to the play areas is restricted to registered Family Account members.
• Children must be supervised by an adult at all times.
• The use of equipment and facilities is at the user’s own risk. The facility is not responsible for injuries resulting from improper use or non-compliance with posted rules.
3.2 Food and Beverage Policy
• Food and beverages purchased from our on-site restaurant may only be consumed in the designated restaurant area.
• No outside food or drinks are permitted within the facility.
3.3 Birthday Parties and Events
• Event bookings must be made in advance through the Application or at the facility.
• A deposit is required to confirm the booking. Deposits are non-refundable if cancellations occur less than 48 hours prior to the event.
• Event decorations and external entertainment must comply with facility guidelines.
3.4 Dedicated Nanny Services
• Subject to availability, a dedicated nanny provided by the facility can be booked for supervision of a child in the play areas.
• Dedicated nanny service is charged for on hourly basis in addition to the facility access fee.
• Liability release: Parents and legal guardians understand that while the dedicated nanny will provide supervision, PLAY CREATE EAT is not responsible for any injuries, accidents, or incidents that may occur while the child is under the nanny’s care. PLAY CREATE EAT does not guarantee the prevention of injuries or other risks associated with play and recreational activities. To the fullest extent permitted by law, the parent or guardian agrees to release, indemnify, and hold harmless PLAY CREATE EAT, its owners, employees, agents, and affiliates from any and all claims, demands, damages, or liabilities arising from or related to the supervision of their child by the dedicated nanny, including but not limited to personal injury, property damage, or any other loss. It is the responsibility of the parent or legal guardian to ensure that their child is in good health and fit to participate in activities at the facility. Parents and legal guardians acknowledge that they remain responsible for their child’s behavior and well-being, even when under nanny supervision.
4. Check-In Rules
4.1 Children Aged Below 8 Years
• Children under the age of 8 must be accompanied and physically checked in by a parent, legal guardian, or authorized caregiver.
• These children must remain under close supervision at all times while in the facility.
4.2 Children Aged 8 to 12 Years
• Children aged 8 to 12 can be checked in by an authorized adult with prior verbal or written consent provided in person or via telephone or via mobile application to PLAY CREATE EAT staff.
• The consent must be confirmed by an authorized adult in the mobile app.
• The facility staff will confirm the consent before allowing entry to the facility.
4.3 Children Aged 12 Years and Older
• Children aged 12 years and older may independently "self-check-in" at the facility.
• Guardians must confirm this authorization for self-checked-in children through the Family Account in the mobile app.
In any case, PLAY CREATE EAT staff will not restrict children from leaving the premises once checked in. Responsibility for ensuring the child’s safety outside the facility lies solely with the parents and/or legal guardians of the children.
5. Health and Safety
5.1 Waiver and Safety Agreement
All guests entering the arcade must sign the waiver of liability provided in the Application or at the entrance. This waiver acknowledges awareness of the inherent risks associated with using our facilities.
5.2 Cleanliness and Hygiene
• Socks must be worn in play areas at all times.
• Guests exhibiting symptoms of illness may be denied entry for the safety of others.
6. Liability Clauses
6.1 Acknowledgment and Assumption of Risk
Guests acknowledge that participation in activities at the facility involves inherent risks, including but not limited to personal injury, disability, illness, or death. These risks may result from the use or misuse of equipment, facilities, or premises. Guests voluntarily accept and assume all risks for themselves and their dependents.
6.2 Medical Considerations
• It is recommended that guests consult a medical professional before engaging in physical activities. Guests affirm that they and their dependents have no medical conditions that could pose a risk during participation.
• Pregnant individuals are strictly prohibited from participating in activities at the facility.
• Guests accept full responsibility for any medical expenses incurred due to injuries or accidents.
6.3 Release of Liability
• Guests release the facility, its employees, directors, and affiliates from any claims or liabilities arising from participation in facility activities, including but not limited to negligence or equipment failure.
• This release extends to all Family Account members, personal representatives, successors, and assigns. It includes but is not limited to the use of play zones, arcade games, and other activities.
• The facility is not liable for any loss, damage, or injuries occurring as a result of misuse, failure to follow guidelines, or inherent risks associated with the activities.
6.4 Caregiver Authorization and Responsibility
• Parents (guardians) can authorize caregivers to accompany children at the facility. Authorized caregivers must comply with all policies and assume responsibility for the children in their care.
• Responsibility for ensuring a child’s safety outside the premises lies with the parent (guardian).
6.5 Marketing and Communication, Photo and Video
We shall not use your personal data for the marketing purposes, i.e., sending you any marketing or promotional materials unless you consented to receiving the aforesaid in the Application. 7. General Terms
7.1 Facility Rules
Management reserves the right to:
• Deny entry or remove guests who fail to comply with these Terms and Conditions.
• Modify these terms, facility rules, and operating hours without prior notice.
7.2 Liability
The facility is not liable for lost, stolen, or damaged personal items. Guests are responsible for securing their belongings.
7.3 Governing Law
These Terms and Conditions are governed by the laws of the United Arab Emirates. Any disputes will be resolved exclusively in the courts of Dubai.
7.4. Provider.
This Application and the actual services rendered hereunder, are tendered to you by PLAY CREATE EAT KIDS AMUSEMENT ARCADE L.L.C, located at Shop 007-011, Cityland mall, Wadi al Safa 4, Dubai, UAE, with the license number 1410682.
